Terms of Service — SVYT BODY

These Terms of Service ("Terms") govern your access to and use of the website svytbody.com (the "Site") and the purchase of products from SVYT BODY ("we", "us", "our").

By accessing our Site or placing an order, you agree to be bound by these Terms.

2. Eligibility

By placing an order on this Site, you confirm that you are at least 18 years old and legally able to enter into a contract.

3. Products and Availability

All products are subject to availability. We reserve the right to limit quantities, discontinue products, and modify product descriptions or pricing.

Changes to pricing apply to future orders only. The price displayed at the time you place your order is the price that applies to that order.

Product images are for illustrative purposes. Colours and appearance may vary slightly due to screen settings, lighting, and fabric stretch.

4. Orders and Contract Formation

Your order constitutes an offer to purchase. A contract is formed when we send you an order confirmation by email.

We reserve the right to refuse or cancel orders where an item is unavailable, where a pricing error is obvious, or where we suspect fraud or unauthorised activity. If we cancel an order after payment, we will refund you in full.

5. Pricing and Payment

All prices are listed in EUR (€) and include VAT at the rate applicable in your delivery country.

Shipping costs are not included in the product price. They are calculated at checkout based on your delivery destination and the shipping option you select, and are displayed to you before you confirm and pay for your order.

We accept payment via:

• Shopify Payments, including major debit and credit cards and iDEAL
• PayPal
• Klarna

Where you pay using Klarna, your payment is subject to Klarna's own terms and conditions, and Klarna may carry out its own checks. Your contract for the goods remains with us.

Payment must be received in full before an order is processed.

6. Pre-Orders

Some products may be offered as pre-orders. By placing a pre-order, you acknowledge that the item is not yet in stock, that estimated dispatch dates are provided as guidance only, and that delays may occur due to production or logistics.

Payment for pre-orders is charged at the time of purchase. You may cancel a pre-order at any time before it ships and receive a full refund.

7. Customer Accounts

You may access your orders through a customer account. Access is granted by means of a one-time code sent to the email address used for your order.

You are responsible for keeping access to that email address secure and for activity carried out through your account. We reserve the right to suspend or terminate accounts that violate these Terms.

This store is hosted by Shopify Inc. By using our store, you acknowledge that Shopify may collect and process your personal data as described in our Privacy Notice, including for the purpose of providing Enhanced Services that incorporate data from your interactions with other merchants and with Shopify.

8. Marketing Communications

If you subscribe to our newsletter or marketing communications, you consent to receive emails from us and may unsubscribe at any time using the link in our emails. Marketing communications are optional and are not required in order to place an order.

9. Shipping and Delivery

Shipping terms are set out in our Shipping Policy, which forms part of these Terms.

We currently ship to countries within the European Union, to Switzerland, and to Ukraine. Orders are dispatched from our facilities in Amsterdam, the Netherlands and Prague, Czech Republic. Our products are manufactured in China.

Delivery times are estimates and are not guaranteed. Unless otherwise agreed, your order will be delivered within 30 days of order confirmation; if we are unable to meet that timeframe, you may cancel your order and receive a full refund.

10. Customs, Duties and Taxes

European Union. All prices include VAT, which is also applied to shipping charges at the rate applicable in your delivery country. No additional taxes, duties or customs fees will be charged on delivery.

Switzerland and Ukraine. Orders are shipped DAP (Delivered At Place). Import duties, taxes and customs handling fees are not included in your order total and are payable by the recipient to the carrier or customs authority on delivery. These charges are set by the destination country. Further detail, including how these charges are treated in the event of a return, is set out in our Shipping Policy and our Returns & Refunds Policy.

11. Right of Withdrawal, Returns and Refunds

Our Returns & Refunds Policy applies to all purchases and forms part of these Terms.

In accordance with EU consumer law, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving a reason. You can exercise this right using the withdrawal function available in the footer of our website and on your order status page, by email to info@svytbody.com, or by using the model withdrawal form set out in our Returns & Refunds Policy.

You are only liable for any diminished value of returned goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning. Where such handling has occurred, we may reduce your refund accordingly, as described in the Returns & Refunds Policy.

12. Legal Guarantee of Conformity

Separately from the right of withdrawal, you benefit from a statutory guarantee that the goods conform to the contract, for a period of two years from delivery.

Where goods do not conform, you are entitled to have them brought into conformity by repair or replacement, or, where that is not possible or proportionate, to a proportionate price reduction or to cancel the contract and receive a refund. This guarantee is provided free of charge and is in addition to any commercial guarantee we may offer.

13. Intellectual Property

All content on this Site — including images, text, designs, graphics, and logos — is owned by or licensed to SVYT BODY. You may not copy, reproduce, distribute, or use any content without prior written permission.

14. Limitation of Liability

To the maximum extent permitted by law, SVYT BODY shall not be liable for indirect, incidental, or consequential damages, and our total liability shall not exceed the amount paid for the product giving rise to the claim.

Nothing in these Terms excludes or limits our liability for:

• death or personal injury caused by our negligence
• fraud, intent, or gross negligence
• liability for defective products under applicable product liability law
• any other liability that cannot be excluded or limited under applicable law

Nothing in these Terms limits your statutory consumer rights.

15. Force Majeure

We are not liable for failure or delay in performance due to events beyond our reasonable control, including natural disasters, strikes, supply chain disruptions, or governmental actions. This does not affect your right to cancel and receive a refund where your order is not delivered.

16. Complaints and Dispute Resolution

If you are not satisfied with your order or our service, please contact us at info@svytbody.com. We aim to acknowledge complaints within 5 business days and to resolve them within 14 days.

We are not obliged to participate, and do not currently commit to participating, in alternative dispute resolution proceedings before a consumer dispute resolution body. You remain free to approach a competent consumer dispute resolution body or a consumer authority in your country of residence.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands.

If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence. You may bring proceedings against us either in the courts of the Netherlands or in the courts of your own country of residence, and we may bring proceedings against you only in the courts of your country of residence.

18. Changes to These Terms

We may update these Terms from time to time. The version in force at the time you place your order is the version that applies to that order. The most current version will always be available on our Site.
